Terms & Conditions
(1) WINDSPEED/ LIVELOAD
By submitting a Payment you acknowledge that it is your responsibility to know the windspeed and live load specifications required by your city’s Building Department. The Patio Kits Direct software integrates with ASCE (American Society of Civil Engineers) to give the best estimation of weather conditions based on your address. Patio Kits Direct will customize your KIT accordingly, but it is your responsibility to confirm the weather condition requirements with your city’s building department if you are getting a permit, and inform your representative of these requirements.
(2) RETURNS
Patio Kits Direct does not offer refunds or returns for ordered material. All material is custom manufactured and made-to-order for each customer. If extenuating circumstances prevail, and are approved by management, any returns are subject to a 50% restocking fee of total amount charged. This requires return to the manufacturer at the expense of the purchaser.
(3) DAMAGE/ MISSING PARTS
By submitting a Payment you acknowledge that you are solely responsible for assessing all material upon delivery, or pick up, for any damage or missing parts. If you are picking up your patio cover, material that is damaged should not leave the manufacturer’s yard, and the manufacturer and Patio Kits Direct should be contacted immediately. We ask that all customers picking up at a will call facility inspect their material prior to leaving the manufacturer’s yard so that we can attempt to rectify immediately while the customer is still on-site.
For customers that receive delivery, or customers that have departed the manufacturer’s yard after pick-up, Patio Kits Direct must be notified of any damage or missing parts WITHIN 5 DAYS of receipt of KIT.
Please DO NOT schedule your build until you have all material and you have inspected for accuracy.
Please DO NOT Install material if you have damage, if the material is drilled or cut in any way, we cannot submit a claim to the manufacturer.
Missing or Damage material claims after 5 days will not be honored by the manufacturer. If the Damage or Missing material claim IS NOT filed with Patio Kits Direct (including providing relevant photos) WITHIN 5 days, customer may be required to purchase replacement material.
(4) INJURY/ STRUCTURAL DAMAGE/ INSTALLATION ISSUES
It is the responsibility of the homeowner and/or the contractor/ builder hired to construct the patio, to ensure that the cover is built according to provided building instructions and engineering requirements. Building instructions are a general guideline for standard structure erection. All details for the build can be found in the engineering packet upon request if kit abides by engineering restrictions. Custom orders outside the scope of engineering do not receive custom building instructions. Patio Kits Direct is not liable for injury or property damage sustained during the build or after the build. Please utilize our professional “live phone support” to ask any questions during your build to help ensure the structure is erected properly and according to requirements. We are happy to help!
5) DELIVERY REQUIREMENTS
Delivery will be fulfilled for customers that purchased delivery price and reside in certain approved regions. Please note; a driver with a truck and trailer must be able to drive into your neighborhood. If the driver is unable, or feels unsafe about the delivery, they will hold your material at the transfer station for customer to arrange your own pickup .
6) CUSTOMER WILL CALL (PICK UP) REQUIREMENTS
It is the customer’s responsibility to arrive for pick ups with an appropriate vehicle for construction material transportation. This includes a truck with ladder rack, flat bed trailer, or box trailer. Inappropriate vehicles for transportation will be denied at the manufacturer location. Please do not arrive to manufacturer with any minors in or outside the vehicle. Customers must wear close-toed shoes. Customers that miss their scheduled pick up time will be charged a $300 fee from the manufacturer. It is the customer’s responsibility to inspect the order for damage or missing parts, once the order leaves the manufacturer location, customer claims all liability. Replacement parts needed after the order has left the manufacturer, will need to be purchased and picked up by customer per terms of pick up pricing.
7) TIME COMPENSATION
Please DO NOT schedule your build until you have received your KIT and thoroughly inspected it. Please DO NOT schedule time off work to receive kit until you have confirmed the time of delivery. Patio Kits Direct is not liable for compensation for lost time due to late or rescheduled deliveries.
8) HOLDS
The price quoted and paid by the customer, for the custom kit, is priced at the current aluminum prices charged by the manufacturer. Customer acknowledges that manufacturing will commence immediately after payment is made. Orders placed will not be authorized for a hold on manufacturing for more than 30 days. Should a customer require that the order be placed on hold for more than 30 days, the original payment will be refunded, and the customer can replace the order once ready, at the current retail price at that time.
9) MATERIAL
Patio Kits Direct purchases wood-grained aluminum from two different manufacturers: Four Seasons (manufacturer of Alumawood and Elitewood) and Duralum Products (manufacturer of Weatherwood). Patio Kits Direct’s software chooses which manufacturer to purchase from based on the material price, so that we can ensure to get our customers the best cost. The material is equivalent in quality, strength and longevity. If customer requires one or the other manufacturer, this will need to be relayed at the time of quoting with your sales representative. Patio Kits Direct does not offer refunds or returns for a requested change in manufacturer once the kit is produced.
10) FINAL PAYMENT TERMS
Upon completion of the final payment, material will be confirmed and available for pick up or delivery within the following 4 – 15 business days. Material is not available on the same day as the final payment is processed, this final payment indicates release to the manufacturer, and scheduling will be completed shortly afterwards. You will receive a notification from customer service to schedule your pick up, or a notification that delivery has been scheduled.
11) DAMAGE AND MISSING CLAIMS
Customer acknowledges that all damaged or missing material claims must be made WITHIN 5 DAYS of receiving the material. This allows Patio Kits Direct the opportunity to file a claim with the manufacturer to replace free of charge. If the Damage or Missing material claim IS NOT filed with Patio Kits Direct (including providing relevant photos) WITHIN 5 days, customer may be required to purchase replacement material depending on timeframe from kit receipt.
12) CANCELLED TRANSACTIONS
All Patio Covers are produced custom for each customer, because of this, we do not accept cancellations or refunds. Should a customer cancel their transaction with the bank, a notice of Intent to Lien will be issued and payment must be remitted for the total transaction.
13) INSTALLMENT PAYMENT TERMS
This contract is valid between Customer and Patio Kits Direct, Inc. , establishing an Installment Payment Plan for a Do-It-Yourself Patio Cover Kit. Installment payments are only available for repeat contracts.
Customer agrees to pay 50% up front for the production of a custom Patio Cover Kit, with final 50% payment to be made when the Kit is goes into production (NOTE: In some cases, this can be as soon as 3 days after the initial payment)
Customer acknowledges and agrees that the first installment payment of 50% of the total kit cost is non refundable and non transferrable. Because Patio Kits Direct must pay the manufacturer for the custom material, as well as overhead involving customer’s order, cancellations of order and refunds are not authorized. The final 50% payment must be collected when the kit goes into production at the manufacturer, and must be made with the same payment method as the initial installment payment.
Patio Kits Direct, Inc. is not liable for delays or extensions of manufacturing lead times, and any delay does not constitute authorization for cancellation or refund of first installment payment.
Patio Kits Direct, Inc. agrees to work with the manufacturer to complete Patio Cover Kit orders as expeditiously as possible working with staffing and material available at the manufacturer. The first 50% payment holds the customer’s spot in the manufacturing queue.
Customer acknowledges that any changes to customer’s order can be discussed and altered with Customer’s sales representative, and changes resulting in an increase or decrease in quoted price will incur a subsequent 50% installment payment or refund on difference between original quoted price and revised quoted price.
Upon execution of this agreement and initial payment of 50%, Patio Kits Direct, Inc. will place customer’s order with the manufacturer. Patio Kits Direct, Inc. will provide customer with updates on manufacturing when available.
14) ENGINEERING REQUIREMENTS
Patio Kits Direct, Inc. will design patio covers according to Engineering provided by the ISCE and specific to each manufacturer’s brand. Patio Kits Direct advises all customers to build their patio cover according to engineering requirements, and offer all engineering documents and support in order to do so, provided the customer has supplied all local environmental requirements and proper design details for their installation location. If a customer chooses to purchase a Patio Cover kit that is designed not conforming to engineering guidelines, or chooses to install their Patio Cover kit outside of engineering guidelines, customer assumes all liability and responsibility should the structure fail due to weather conditions or otherwise. Customer releases Patio Kits Direct from all liability in the event a patio cover is constructed outside of engineering guidelines and causes injury, death or property damage.
15) WARRANTY
The manufacturers provide warranty on the paint system, any material warranty claims must be made through the manufacturer’s website and Patio Kits Direct should be informed. Warranty claims will only be honored if the material was constructed per engineering guidelines, and the material is available for inspection at the job site.
